Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Vinylr mobile application and services (the “Service” or the “App”). Vinylr (“Vinylr”, “we”, “us”) is a social app for ranking albums and logging live concerts.
1. Acceptance of the Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. Your continued use of the Service constitutes acceptance of any updates we publish.
2. Eligibility and minimum age
You must be at least 13 years old to use Vinylr (or the higher minimum age required by the laws of your country of residence). If you are a minor under applicable law but older than 13, you represent that you have the consent of your parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service. By using the App you represent that the information you provide is truthful and that you have the legal capacity to be bound by these Terms.
3. Account and security
You are responsible for your account and for all activity that occurs under it, including keeping your credentials confidential. You can sign up with an email address or by signing in with Apple or Google. You must notify us immediately of any unauthorized use of your account by writing to legal@vinylr.app. We cannot guarantee security against access resulting from the mishandling of your credentials.
4. Acceptable use and prohibited conduct
When using Vinylr, you agree not to:
- Post content that is illegal, defamatory, harassing, hateful, threatening, sexually explicit, violent, or that infringes the rights of others.
- Impersonate any person, brand, or entity.
- Harass, intimidate, or abuse other users; send spam or unsolicited messages through direct messages (DMs).
- Scrape data through automated means, reverse-engineer the Service, or attempt to breach its security.
- Use the Service for fraudulent purposes or to circumvent these Terms.
We enforce a zero-tolerance policy toward objectionable content and abusive behavior. Any user can report content or profiles and block other users from within the App.
5. User Content (UGC)
The Service lets you post content: concert photos and videos, comments, ratings and rankings, “Backstage” posts (artists), song of the day, direct messages, and profile information (collectively, “User Content”).
Representations and warranties. You represent and warrant that you own, or have all rights, licenses, and permissions necessary to, the User Content you post, and that such content does not infringe the intellectual property, privacy, publicity, or any other rights of third parties.
License. You retain ownership of your User Content. By posting it, you grant Vinylr a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license (to our infrastructure providers, solely to operate the Service) to host, store, reproduce, technically adapt, display, distribute, and publicly communicate that content within the Service for the purpose of operating, promoting, and improving it. This license ends when you delete the content or your account, except for residual technical backups or where the content has already been shared with third parties within the Service.
Indemnification.You agree to indemnify and hold harmless Vinylr, its partners, officers, and employees from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising from the User Content you post or from your breach of these Terms.
6. Vinylr intellectual property
The App, its code, design, the pairwise-comparison ranking engine, the “Vinylr” brand, logos, and other elements are owned by Vinylr or its licensors and are protected by intellectual property law. You are granted no rights in them other than the limited, personal, revocable, and non-transferable license to use the App in accordance with these Terms.
7. Music, previews, and streaming links
The App displays catalog metadata (artists, albums, cover art, concerts) and 30-second audio previews provided by third parties (for example, Apple) for identification purposes. These previews are owned by their respective rights holders; Vinylr grants no rights over the recordings, does not allow them to be downloaded, and does not transfer any ownership of them to you. Where available, we may offer deep links to third-party streaming services; use of those services is governed by their own terms.
8. Vinyl Marketplace
Vinylr may allow users to connect with each other via direct message to sell or trade vinyl. Vinylr only facilitates the connection: it does not process payments, is not a party to any transaction, does not handle delivery, and does not verify or guarantee the items, their authenticity, condition, price, or the parties' performance. Any transaction takes place directly between users, at their own risk and responsibility. We recommend taking precautions when meeting or paying. Vinylr will not be responsible for disputes, fraud, or damages arising from these transactions.
9. DMCA / Notice and takedown
We respect intellectual property rights. If you believe that content on Vinylr infringes your copyright, send a notice to legal@vinylr.app (our copyright contact) including: (i) your contact information; (ii) identification of the copyrighted work; (iii) identification and location of the allegedly infringing content within the App; (iv) a good-faith statement that the use is not authorized; (v) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf; and (vi) your physical or electronic signature.
We will remove or disable the relevant content. The affected user may submit a counter-notice with equivalent elements if they believe the removal was mistaken. We may terminate repeat infringers.
10. Moderation, suspension, and termination
We review reports and may remove content and suspend or terminate accounts that violate these Terms, generally within 24 hours of a report. You may delete your account and your content at any time from Settings → Delete account. We may suspend or discontinue the Service, in whole or in part, with or without prior notice.
11. Disclaimer of warranties (“as is”)
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including those of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, and we are not responsible for content posted by other users or for data obtained from third-party sources.
12. Limitation of liability
To the maximum extent permitted by applicable law, Vinylr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or reputation, arising from the use of or inability to use the Service. In any event, Vinylr's total liability will be limited to the extent permitted by applicable law.
13. Indemnification
You agree to indemnify and hold Vinylr harmless from third-party claims arising from your use of the Service, your User Content, your participation in the Marketplace, or your breach of these Terms or of the law.
14. Changes to the Terms
We may update these Terms. We will post the current version on this page with its update date. If the changes are material, we will make reasonable efforts to notify you through the App.
15. Governing law and jurisdiction
These Terms are governed by the laws of Mexico. For their interpretation and enforcement, the parties submit to the jurisdiction of the competent courts of Mexico, waiving any other venue that might otherwise apply.
